Mahkemece davan\u0131n k\u0131smen kabul\u00fcne karar verilmesi \u00fczerine h\u00fck\u00fcm daval\u0131 vekili taraf\u0131ndan temyiz edilmi\u015ftir.&nbsp;<\/p>\n\n\n\n<p>Davac\u0131 vekili dava dilek\u00e7esinde; daval\u0131n\u0131n m\u00fcvekkiline ait ta\u015f\u0131nmazda 01\/03\/2006 ba\u015flang\u0131\u00e7 tarihli kira s\u00f6zle\u015fmesi ile kirac\u0131 iken ta\u015f\u0131nmaz\u0131 01\/12\/2012 tarihinde tahliye etti\u011fini, kiralanan ta\u015f\u0131nmaz s\u00f6zle\u015fmeye g\u00f6re yeni boyanm\u0131\u015f halde olmas\u0131na ra\u011fmen bu \u015fekilde teslim edilmedi\u011fini, ta\u015f\u0131nmaz\u0131n k\u00f6t\u00fc kullan\u0131lm\u0131\u015f oldu\u011funu, yap\u0131lan delil tespiti sonucunda<\/p>\n\n\n\n<p>haz\u0131rlanan bilirki\u015fi raporunda ta\u015f\u0131nmaz\u0131n k\u00f6t\u00fc kullan\u0131m\u0131ndan kaynaklanan hasarlar\u0131n 4756 TL ye giderilebilece\u011finin tespit edildi\u011fini, daval\u0131n\u0131n erken tahliye nedeni ile \u00fc\u00e7 ayl\u0131k kira bedelini \u00f6dedi\u011fini ancak belirtilen aylara ili\u015fkin aidat bedellerini \u00f6demedi\u011fini, \u00fc\u00e7 ayl\u0131k aidat miktar\u0131n\u0131n 1050 TL oldu\u011funu ayr\u0131ca daval\u0131 taraf\u0131ndan \u00f6denmeyen elektrik borcu nedeni ile 59,50 TL nin m\u00fcvekkili taraf\u0131ndan \u00f6dendi\u011fini belirterek toplam 5865 TL nin daval\u0131dan tahsiline karar verilmesini talep etmi\u015ftir. Daval\u0131 vekili; delil tespitinde belirlenen masraf kalemlerinin s\u00f6zle\u015fme dikkate al\u0131nmadan hesapland\u0131\u011f\u0131n\u0131 hesap edilen masraf bedellerine ili\u015fkin hususlar\u0131n s\u00f6zle\u015fmede ne durumda oldu\u011funun belirtilmedi\u011fini, delil tespiti bilirki\u015fi raporunun denetime elveri\u015fli olmad\u0131\u011f\u0131n\u0131, kiralanan kendisine teslim edilirken duvar ka\u011f\u0131d\u0131 \u00fczerine boyanarak teslim edildi\u011fini, davac\u0131n\u0131n kap\u0131c\u0131 ile onar\u0131m konusunda 1000 TL ye anla\u015fmas\u0131na ra\u011fmen belirtilen miktarda hasar bedeli talep etti\u011fini, erken tahliye nedeni ile iyiniyetle \u00fc\u00e7 ayl\u0131k kira bedelinin \u00f6dendi\u011fini, evin ne kadarl\u0131k s\u00fcrede kiraya verilebilece\u011fi, davac\u0131n\u0131n gerekli \u00e7abay\u0131 sarfedip sarfetmedi\u011fi hususlar\u0131n\u0131n tespiti ile bu y\u00f6nde talepte bulunulmas\u0131 gerekti\u011fini, m\u00fcvekkilinin \u00f6demesi esas al\u0131narak ayn\u0131 d\u00f6neme ili\u015fkin aidat talep edilmesinin hukuka ayk\u0131r\u0131 oldu\u011funu, bahsedilen elektrik bedelinden sorumlu olmad\u0131\u011f\u0131n\u0131 belirterek davan\u0131n reddini savunmu\u015ftur.&nbsp;<\/p>\n\n\n\n<p>Mahkemece yap\u0131lan yarg\u0131lama s\u0131ras\u0131nda mahallinde ke\u015fif yap\u0131larak bilirki\u015fi raporu al\u0131nm\u0131\u015f olup h\u00fckme esas al\u0131nan bilirki\u015fi raporunda hor kullanmadan dolay\u0131 meydana gelen hasarlar\u0131n giderilmesi i\u00e7in 2836 TL harcanmas\u0131 gerekti\u011fini \u00fc\u00e7 ayl\u0131k aidat bedelinin 1050 TL ve elektrik paras\u0131n\u0131n 59,50 TL oldu\u011funu toplam miktar\u0131n 3945,50 TL olarak hesapland\u0131\u011f\u0131n\u0131, ta\u015f\u0131nmaz\u0131n iki ayl\u0131k s\u00fcrede yeniden kiraya verilebilece\u011fini belirtmi\u015ftir.&nbsp;<\/p>\n\n\n\n<p>Mahkemece yap\u0131lan yarg\u0131lama sonucunda davaya konu ta\u015f\u0131nmaz\u0131n yeniden iki ayl\u0131k s\u00fcrede kiraya verilebilece\u011fi esas al\u0131narak daval\u0131 kirac\u0131n\u0131n pe\u015finen \u00fc\u00e7 ayl\u0131k kira bedeli tutar\u0131nda yeniden kiralama s\u00fcresi kira bedeli \u00f6demesinden, bir ayl\u0131k kira bedeli olan 730 TL mahsup edilerek kalan 3215,50 TL nin daval\u0131dan tahsiline karar verilmi\u015ftir.&nbsp;<\/p>\n\n\n\n<p>1\u00ad ) Dosya kapsam\u0131na, toplanan delillere, mevcut deliller takdir edilerek karar verilmi\u015f olmas\u0131na ve takdirde de bir isabetsizlik bulunmamas\u0131na g\u00f6re daval\u0131 vekilinin a\u015fa\u011f\u0131daki bendin kapsam\u0131 d\u0131\u015f\u0131nda kalan temyiz itirazlar\u0131 yerinde de\u011fildir.&nbsp;<\/p>\n\n\n\n<p>2\u00ad ) Daval\u0131 vekilinin h\u00fck\u00fcm alt\u0131na al\u0131nan aidat bedeli alaca\u011f\u0131na y\u00f6nelik temyiz itirazlar\u0131na gelince; Mahkemece yap\u0131lan yarg\u0131lama sonucunda daval\u0131n\u0131n iki ayl\u0131k yeniden kiralama s\u00fcresince kira paras\u0131ndan sorumlu oldu\u011fu, davac\u0131 taraf\u0131ndan \u00f6denen \u00fc\u00e7 ayl\u0131k kira bedelinden bir ayl\u0131k fazla \u00f6deme mahsup edilerek karar verildi\u011fi halde, h\u00fckme esas al\u0131nan bilirki\u015fi raporunda \u00fc\u00e7 ayl\u0131k aidat bedeli olan 1050 TL \u00fczerinden hesaplama yap\u0131lm\u0131\u015f olup, kabule g\u00f6re daval\u0131n\u0131n iki ayl\u0131k yeniden kiraya verilme s\u00fcresi i\u00e7inde aidat bedelinden sorumlu tutulmas\u0131 gerekirken yaz\u0131l\u0131 \u015fekilde h\u00fck\u00fcm kurulmas\u0131 do\u011fru olmad\u0131\u011f\u0131ndan h\u00fckm\u00fcn bu sebeple bozulmas\u0131 gerekmi\u015ftir.&nbsp;<\/p>\n\n\n\n<p>SONU\u00c7 : Yukar\u0131da ( 2 ) nolu bentte a\u00e7\u0131klanan nedenlerle temyiz itirazlar\u0131n\u0131n kabul\u00fc ile 6100 say\u0131l\u0131 HMK.ya 6217 Say\u0131l\u0131 Kanunla eklenen ge\u00e7ici 3.madde h\u00fckm\u00fc g\u00f6zetilerek HUMK.n\u0131n 428.maddesi uyar\u0131nca h\u00fckm\u00fcn BOZULMASINA, istek halinde pe\u015fin al\u0131nan temyiz harc\u0131n\u0131n temyiz edene iadesine, 29.01.2015 tarihinde oybirli\u011fiyle karar verildi.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>T.C.&nbsp; YARGITAY6.
